SAN JUAN COUNTY

AMENDMENT TO ORDINANCE NO. 10

AMENDING THE SAN JUAN COUNTY ANIMAL CONTROL ORDINANCE, ADOPTED ON AUGUST 21, 1986, TO EXEMPT LIVESTOCK FROM CERTAIN PROVISIONS AND TO PERMIT THE USE OF APPROVED RABIES VACCINES WHICH HAVE AN EFFECTIVE LIFE OF MORE THAN ONE YEAR.

            WHEREAS,  San Juan County Ordinance No. 10, Section 5.2 does not exempt livestock from the prohibitions of animals running at large; and

       

            WHEREAS, NMSA 1978 Section 77-14-1, et. seq. provides that livestock may run at large, unless appropriate fencing has been constructed; and

            WHEREAS, the New Mexico Department of Health has approved a rabies vaccine for use having an effective life of more than one year; and

            WHEREAS, the Board of County Commissioners of San Juan County finds that amending the Animal Control Ordinance so as to comply with state law will promote the public health, safety, welfare and convenience of the citizens of the County.

            NOW, THERFORE, BE IT ORDAINED AS FOLLOWS:

1.      Section 5.2 of the Animal Control Ordinance entitled “Animals Running at Large” is amended by adding the following sentence:  “Notwithstanding any provision herein, this section shall not be applicable to livestock as defined in Section 1.12 of this Ordinance.”

2.      Section 3.1 of the Animal Control Ordinance entitled “Annual Vaccination” is amended by adding the following sentence:  “Notwithstanding any provision herein, it shall be lawful to administer a three-year rabies vaccine licensed by the United States Department of Agriculture.  If such vaccine is utilized, the certificate issued to the owner or keeper of the animal shall specifically indicate that a three-year vaccine was administered.”

PASSED, APPROVED AND ADOPTED THIS 2ND DAY OF AUGUST, 2006.
