A COUNTY ORDINANCE DEFINING CABLE TELEVISION SERVICE AND PROVIDING PENALTIES FOR THE UNLAWFUL TAMPERING OR CONNECTION WITH THE EQUIPMENT PROVIDING CABLE TELEVISION SERVICE WITHOUT PAYMENT; AND PROVIDING THE MANNER OF ENFORCEMENT.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF SAN JUAN COUNTY.

SJC-22-1 - CABLE TELEVISION SERVICE DEFINED

Cable television service means any and all services provided by or through the facilities with any cable television system or closed circuit coaxial cable communication system or any microwave or similar transmission service used in connection with any cable television system or other similar closed circuit coaxial cable communications system.

SJC-22-2 - It shall be unlawful for any person to tamper with or make or continue connection with the equipment providing cable television service without payment of the lawful charges for cable television service. If, within a reasonable time after a person knew or should have known of a connection continued in violation of this section, that person notifies the person providing the cable television service of the connection, the person so notifying shall not be liable for any violation of this section.

Whoever commits unlawful tampering or connection with equipment providing cable television service is guilty of a misdemeanor and shall be fined not to exceed Three Hundred Dollars ($300) or imprisonment for ninety days (90) or both such fine and imprisonment.
