SAN JUAN COUNTY

AN ORDINANCE PROHIBITING THE SALE, EXHIBITION

OR DISSEMINATION OF OBSCENE MATERIAL,

AND PROHIBITING THE POSSESSION OF OBSCENE MATERIAL

WITH THE INTENT TO SELL, EXHIBIT OR DISSEMINATE.

This Ordinance may be referred to as the "San Juan County Anti-Obscenity

Ordinance."

For purposes of this Ordinance, the phrase, "obscene material" shall be defined as material (written, pictorial or recorded), which: (A) taken as a whole, appeals to the prurient interest in sex as judged by the average person applying local contemporary community standards; (B) describes or depicts in a patently offensive manner, any of the following behavior designed or intended to stimulate sexual excitement: the description, depiction or simulated portrayal of the acts of sodomy, fellatio, cunnilingus, masturbation, excretory functions, ejaculation, sexual intercourse, bestiality, sadism or masochism; and (C) taken as a whole, lacks serious literary, artistic, political or scientific value.

It shall be unlawful to knowingly sell, exhibit or disseminate in any manner obscene material.

It shall be unlawful to knowingly possess obscene material with the intent to sell,

exhibit or disseminate same.
